A lawyer representing Enrique Tarrio, the former leader of the Proud Boys, has formally requested a pardon from President-elect Donald Trump for his involvement in the January 6 Capitol riots. The request, articulated in a letter by attorney Nayib Hassan, highlights Tarrio's ongoing 22-year prison sentence for charges of seditious conspiracy, marking the longest sentence assigned to any participant from the January 6 events.

In his letter, Hassan described Tarrio as a “young man with an aspiring future ahead of him” and contested the portrayal of Tarrio during his trial as a leader of an extremist organization. Notably, Tarrio was arrested on January 4, 2021, prior to the Capitol attack and was subsequently ordered to leave Washington, D.C., under prior charges for unrelated incidents involving a burning of a Black Lives Matter banner (HuffPost). Despite his absence from the Capitol on that day, prosecutors argued that he played a pivotal role in orchestrating the efforts that resulted in the violent breach.

Hassan noted in the communication to Trump that “the government pushed forward charging and prosecuting Henry” for merely expressing his views. Furthermore, the letter underscores alarming conditions in which Tarrio is held in prison, claiming he has restricted access to outdoor time, which has taken a toll on his mental health.

The court proceedings against Tarrio revealed that although he did not physically partake in the storming of the Capitol, he was in communication with members of the Proud Boys and incited them through various channels, expressing pride in their actions as the chaos unfolded. During the riot, he messaged fellow members, stating “Proud of my boys” and later declared, "We did this" (CBS News).

Hassan expressed hope that a pardon would allow Tarrio to reintegrate into society and diminish the social stigmas attached to him, emphasizing a commitment to legal and peaceful contributions to his community. “Granting this pardon would allow [Enrique] to reintegrate into a family that is extremely supportive and would further demonstrate commitment to lawful, peaceful, and constructive contributions,” he wrote (The Hill).

The Trump transition team has not yet commented on the pardon request. Transitioning into the presidency, Trump has hinted at considering pardons for individuals involved in the January 6 incidents; however, specifics regarding how these requests would be approached remain unclarified.
