  • A U.S. court ordered the Trump administration to cancel taxpayer-funded political ads.
  • Judge Jennifer L. Rochon issued a temporary restraining order against the ads.
  • The ads, funded by a $20 million DHS allocation, were deemed a misuse of taxpayer funds.

A U.S. court has ordered the Trump administration to cancel television commercials funded with millions of taxpayer dollars that promoted the president's political message. U.S. District Judge Jennifer L. Rochon in New York issued a temporary restraining order directing the administration to cancel any remaining advertisements, including those scheduled to air that night. The order was in response to a challenge from nonpartisan watchdog Common Cause, which claimed the ads were an illegal misuse of taxpayer funds, according to Indiatimes and Los Angeles Times.

In her ruling, Judge Rochon stated, “Defendants shall not enter into, renew, or expand any agreement authorizing the development, creation, dissemination, placement, or airing of the challenged advertisements” during the two-week period covered by her order. The Justice Department argued that the order was not necessary since "the alleged offending conduct will end tomorrow,” pointing to the administration's claims that the ad campaign was coming to an end, according to CBS News and Los Angeles Times.

The Department of Homeland Security allocated $20 million in taxpayer money for the advertisements, which legal experts have indicated may violate a federal statute prohibiting the use of congressionally appropriated funds for "publicity or propaganda." As stated by plaintiffs represented by Democracy Forward, a nonprofit legal organization, there is “no legal justification — and no precedent — for the president to use the machinery of the government and funds set aside by Congress for other uses to influence electoral outcomes,” according to Los Angeles Times and Indiatimes.

The ads began airing in late September and were criticized for their political messaging. Some featured Trump discussing the threat of communism, while others echoed campaign messages from his previous presidential bid. Criticism extended to members within the GOP, including Senate Majority Leader John Thune, who remarked, “It shouldn’t be paid for with taxpayer dollars,” highlighting bipartisan discontent over the issue, according to CBS News and Los Angeles Times.
