A Dutch court has mandated Elon Musk's artificial intelligence company, xAI, to immediately cease the generation and distribution of nonconsensual sexual imagery via its Grok chatbot. This decision, issued by the Amsterdam District Court, prohibits the creation of images depicting individuals "partially or wholly stripped naked without having given their explicit permission," threatening fines of €100,000 (approximately $115,350) per day for noncompliance, according to Reuters and Al Jazeera.
The ruling represents a significant precedent as it emphasizes the responsibility that AI companies hold regarding the use of their tools. The suit against xAI was launched by Offlimits, a Dutch nonprofit focused on combating online sexual abuse, in collaboration with the Victims Support Fund. During the court proceedings, Offlimits demonstrated that Grok was still capable of creating images of nude individuals using real photos, undermining xAI's claims about the effectiveness of their preventive measures, as stated by India Times and Al Jazeera.
The court's decision comes amid a surge of complaints and investigations into Grok's functions, raising concerns across multiple jurisdictions, including Europe and the Americas. Offlimits director Robbert Hoving highlighted that the "burden is on the company" to ensure that its AI tools are not misused, particularly regarding the creation of nonconsensual sexual images, as reported by Reuters, Al Jazeera, and India Times.
This landmark ruling is one of the first instances in Europe where a court has held AI companies accountable for their outputs. It not only sheds light on the responsibilities of AI developers but also aligns with ongoing discussions in the European Parliament regarding the regulation of AI systems generating sexualized deepfakes, according to Al Jazeera and Reuters.
