Chief Justice John Roberts recently issued a grave warning regarding threats to the independence of the federal judiciary, underscoring the increasing instances of violence, intimidation, and disinformation directed at judges. In his year-end report, Roberts expressed concerns over what he termed “illegitimate activity” that not only undermines judicial authority but also poses a risk to the rule of law.
Roberts reported a staggering increase in threats against federal judges, indicating that the U.S. Marshals Service has investigated over 1,000 serious threats in the past five years. This alarming trend includes attempts at doxing judges, where their personal information is made public for harassment purposes. Roberts stated, “These dangerous suggestions, however sporadic, must be soundly rejected,” referring to calls by some public officials to disregard unfavorable court rulings, which he indicated breed an environment of threat and hostility.
In light of these challenges, Roberts highlighted the necessity of maintaining judicial independence through robust public engagement. He noted that while criticism of the judiciary is not inherently damaging, excessive intemperance from public officials can lead to dangerous reactions from others. “Public officials certainly have a right to criticize the work of the judiciary,” Roberts emphasized, adding that they must be cautious with their language as it can have real-world implications.
Moreover, the Chief Justice referenced ongoing concerns regarding high-profile decisions made by the Supreme Court that have incited partisan backlash, including rulings related to abortion rights and the immunity granted to former President Donald Trump. In his report, Roberts suggested that the ongoing “storm of partisan rhetoric” jeopardizes the Court's credibility, implying that it might empower those seeking to openly defy the Court's authority.
During his address, Roberts recalled historical precedents, urging a collective appreciation for judicial independence. He warned that the judiciary's integrity hinges on the respect for law and governance that the Founding Fathers envisioned.
