Democratic Representative LaMonica McIver has been charged with assaulting federal law enforcement officers during a protest outside an Immigration and Customs Enforcement (ICE) facility in Newark, New Jersey, on May 9. The charges were announced by Alina Habba, the acting U.S. Attorney for New Jersey, who stated that McIver had “assaulted, impeded and interfered with law enforcement” during the incident, which involved other Democratic lawmakers and resulted in the arrest of Newark Mayor Ras J. Baraka, according to HuffPost and New York Times.

McIver was participating in a congressional oversight visit alongside Baraka and her colleagues, Reps. Bonnie Watson Coleman and Rob Menendez, to inspect conditions at the Delaney Hall ICE facility, which recently began operations under a controversial contract with the GEO Group. The visit turned chaotic when ICE agents blocked Baraka’s entry, leading to tensions which resulted in McIver allegedly elbowing officers and attempting to block the mayor's arrest, as reported by ABC News and CBS News.

Her attorney, Paul Fishman, criticized the charges as "spectacularly inappropriate" and claimed they were an attempt to shift blame from ICE's actions to McIver. He emphasized that she was fulfilling her congressional responsibilities to oversee treatment of detainees at the facility, according to India Times and The Hill.

In response to the charges, McIver publicly declared that the situation was distorted for political reasons, stating, "These charges against me are purely political — they mischaracterize and distort my actions," in a statement shared on social media. Numerous House Democrats have echoed her sentiments, labeling the prosecution as a politically motivated attack designed to intimidate legislators exercising their oversight duties, as highlighted by Al Jazeera and The Hill.

Throughout this controversy, the U.S. Attorney’s office has maintained that no one is above the law, reinforcing their assertion that the prosecution is necessary to uphold justice impartially.
