U.S. District Judge Ana Reyes found Trump's January 27 order to exclude transgender troops likely infringed upon the U.S. Constitution's prohibition against sex discrimination. Reyes emphasized in her decision, “the cruel irony is that thousands of transgender service members have sacrificed — some risking their lives — to ensure for others the very equal protection rights the military ban seeks to deny them,” as reported by HuffPost.

The Department of Defense had indicated that it would enforce this ban, which asserted that allowing transgender individuals in the military threatened military readiness and unit cohesion. Following the ruling, Reyes stated her decision would remain on hold until Friday to allow the government time to file an appeal.

In her 79-page opinion, Reyes scrutinized the Defense Department’s justifications for the ban, suggesting they relied on outdated studies that misrepresented data concerning the readiness and mental health of transgender service members. For instance, she highlighted that while the administration claimed that the cost of gender-affirming care for transgender troops was prohibitively expensive, the military spends substantially more on healthcare for non-transgender service members. Reyes pointed out, “the military spent $42 million on Viagra in 2024, substantially more than the $5.2 million spent on gender-affirming care for transgender service members last year,” as noted in Channel News Asia.

The ruling was praised by advocates for transgender rights, with Jennifer Levi of GLAD Law asserting that it underscores the capabilities and dedication of transgender service members. “This ruling pulls no punches. The court methodically documented the concrete harms this ban inflicts on brave transgender service members who ask nothing more than to serve their country with honor,” Levi stated.

The Trump administration's effort to ban transgender troops is part of a broader thesis that has seen similar judicial challenges to other Trump-era policies regarding transgender rights, including the recent incident where NPR reported on attempts to reduce healthcare access for transgender veterans.
