Rep. Jamie Raskin, the leading Democrat on the House Judiciary Committee, has called for Supreme Court Justice Samuel Alito to recuse himself from any deliberations related to President-elect Donald Trump’s hush money case. This demand follows a controversial phone call between the two, which occurred just hours before Trump's legal team filed an emergency appeal to delay his criminal sentencing in New York.
During his statement, Raskin highlighted the timing of the call, stating, “Yesterday, we learned that President Trump spoke to Justice Alito just hours before Trump asked the Supreme Court to halt his criminal sentencing.” He criticized Alito's decision, asserting that it represents a significant breach of judicial ethics. Raskin noted that such a direct communication is unprecedented and troubling, given Alito's past affiliations with Trump and the implications of impartiality in judicial proceedings. “In our democracy, Americans expect their cases to be heard by impartial judges,” he emphasized.
The phone call, confirmed by Alito, ostensibly concerned a job recommendation for one of his former law clerks, William Levi, who was under consideration for a government role. Alito claimed that the call did not address Trump's sentencing application and stated, “We did not discuss the emergency application he filed today, and indeed, I was not even aware at the time of our conversation that such an application would be filed” (India Times).
However, skepticism remains regarding the propriety of the interaction. Raskin remarked that Alito’s choice to engage in this private telephone conversation illustrates either a severe misunderstanding of judicial ethics or a belief that he is exempt from such standards. He pointed out, "The mere act of having a personal telephone conversation with the president-elect, while he has active interests in matters currently pending before the court, is plainly sufficient to trigger a situation in which the Justice’s impartiality might reasonably be questioned.”
